GENERAL PAYMENT TERMS
These General Payment Terms regulate the payment terms of the services Dunav Tours Hotels JSC provides to its clients and the same shall be valid from the start of 2024 season.
1. Dunav Tours Hotels JSC makes an invoice for the services rendered to its clients and sends it to them via email on the day when it is made.
2. The clients shall pay the due amounts for the services provided by Dunav Tours Hotels JSC within 30 (thirty) calendar days from the date of the invoice making to the bank account stated in the invoice.
3. With any payment the clients shall state the registration numbers of invoices, which are being paid – in the bank transfer form or in a separate description enclosed to it, which should be sent to the following email address: invoiceDTH@dunavtours.bg. If the invoice registration numbers are not explicitly stated, Dunav Torus Hotels JSC closes the due amounts chronologically in the order of their occurrence.
4. If the client does not pay the due amount to Dunav Tours Hotels JSC within the 30-day period stated in these General Payment Terms, then a penalty shall be paid to the amount of 0.1% of the due amount for each day of delay, but not more than 30% of it, becoming effective from the 31st day of invoice making.
5. If the client delays any payment over 30 (thirty) days after the expiry of the term set in art. 2 of these General Payment Terms, Dunav Tours Hotels JSC has the right to refuse the provision of services when the same client requests new ones.
6. Any disputes, which arise between Dunav Tours Hotels JSC and its clients, regardless if they are in an effective agreement or there is a request for the provision of Dunav Tours Hotels JSC services, shall be solved by the competent Bulgarian court in Ruse and the effective Bulgarian law shall be applied.
7. The agreement form of choosing a competent court and applicable law under art. 6 is consistent with the practice of contractual relations that Danube Tours Hotels JSC has established with its customers. The agreement under art. 6 is considered to have been executed duly with an assignment or confirmation by the client of a certain service to be performed by Dunav Tours Hotels JSC.
These General Payment Terms are considered to be accepted by the client and are a part of the relation between the parties as Dunav Tours Hotels JSC confirms the provision of services to the client or the latter request such services.
